Marketplace Terms of Use:

Our platform serves as a marketplace for artists and designers, referred to as "Sellers," to upload and sell their creative designs in the form of stickers and digital downloads. Sellers can register and submit their artwork through a dedicated vendor portal, which is then reviewed and activated for sale in our store. Customers, or "Buyers," can purchase these designs either as digital downloads, available for instant worldwide delivery, or as physical stickers, available only in the USA. In the case of physical stickers, we handle the printing and shipping. Sellers earn a commission for each sale, the amount of which is expressly detailed on our “Become a Seller” page.

1. Content Usage: All digital downloads available on our platform are intended for use as defined by the Seller. Buyers may use the content for personal or commercial purposes, only as explicitly stated by the Seller.
   
   
2. Intellectual Property: The intellectual property rights of all digital downloads belong to the respective Seller. Users are prohibited from copying, distributing, or modifying any content without explicit permission from the Seller, unless otherwise stated by the Seller for specific commercial use.
   
   
3. Seller Responsibilities: Sellers are responsible for clearly stating the permitted usage of their content. Sellers are responsible for the content they upload and list on the marketplace. By listing an item on the marketplace, the Seller represents and warrants that they own or otherwise control all the rights to the content they post and that it does not violate or infringe upon the rights of any third party, including copyright, trademark, or rights of publicity or privacy. Sellers agree to indemnify, defend, and hold Decal Venue and its associated officers, directors, shareholders, employees, and agents harmless from and against all claims, liabilities, damages, and expenses, including reasonable attorney's fees, arising from or relating to: (i) any breach of these representations; or (ii) any dispute brought by a third party or complaint by a Buyer concerning the works or content Seller has uploaded.
   
   
4. Buyer Responsibilities: Buyers are responsible for reviewing and understanding the terms and conditions set by Sellers before making a purchase. They must comply with the specified usage rights defined by the Seller and refrain from exceeding the permitted usage without additional permissions from Seller. Buyer agrees to indemnify, defend, and hold Decal Venue and its associated officers, directors, shareholders, employees, and agents harmless from and against all claims, liabilities, damages, and expenses, including reasonable attorney's fees, arising from or related to any use of the purchased items that falls outside of the permitted uses as defined by the Seller or these Terms of Service.
   
   
5. Seller License to Us: When Seller (you) submit artwork to Decal Venue, you grant us non-exclusive, irrevocable, sublicensable, and royalty-free license to reproduce, distribute, and modify your design for the purpose of printing on stickers and selling sticker products or otherwise provide Services or products we may offer. This means that while we have an irrevocable license for your artwork for any commercial purposes, you are the sole owner of the artwork and free to grant similar rights to other parties or use your artwork in other ways. In addition, you grant Decal Venue a non-exclusive, irrevocable, and royalty-free license to use your artwork for advertising and promotional purposes. This includes, but is not limited to, featuring your design on our website, social media platforms, and in marketing materials such as brochures or advertisements. Decal Venue may also collaborate with third parties to promote and distribute products featuring your artwork, while giving appropriate credit to you as the artist.
   
   
6. Seller License to Buyer. The specific license granted by the Seller to the Buyer for the use of purchased items will be prominently displayed on the product description page, categorized as either “Personal Use Terms”, “Commercial Use Terms”, or both. All Buyers must adhere to the usage rights as specified on the product description page for any purchased products.
   
   
7. Retention of Ownership: Despite granting Decal Venue an irrevocable commercial license to use your (Seller) artwork, you maintain full ownership and rights to your artwork.
   
   
8. Decal Venue IP: Decal Venue retains all rights, title, and interest in and to all intellectual property related to the marketplace platform, including but not limited to software, graphics, user interface, and any software code or data related thereto. This includes any updates, enhancements, or modifications made thereto. Decal Venue grants Buyers and Sellers a limited, non-exclusive, non-transferable, and revocable license to access and use the marketplace platform solely for the purposes of buying, selling, and listing items in accordance with these Terms of Service. This license does not convey any rights of ownership in or related to the marketplace platform, or any intellectual property rights owned by Decal Venue. Neither Buyers nor Sellers may use, copy, adapt, modify, decompile, reverse engineer, disassemble, decrypt, attempt to derive the source code of, or create derivative works based on the marketplace platform or any part thereof, except as explicitly permitted by Decal Venue.
   
   
9. Age Requirement for Sellers and Buyers: Individuals must be at least 18 years of age to register as a Seller on Decal Venue. By registering, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into and be bound by contractual agreements. For Buyers, individuals under 18 years of age may use Decal Venue for purchases only with the explicit consent and involvement of a parent or guardian. By making a purchase, you affirm that you are either at least 18 years old or have obtained the necessary consent of a parent or guardian who agrees to be bound by these Terms of Service. Parents or guardians are responsible for any and all activities conducted through the account of a minor. Decal Venue reserves the right to request proof of age and parental consent, and to refuse service, terminate accounts, or cancel transactions of any users who do not meet these age requirements.
   
   
10. Prohibited Content: Any content that is offensive, discriminatory, or violates intellectual property rights is strictly prohibited on our platform. We reserve the right to remove such content and take appropriate action against users who violate this policy.
    
    
11. Privacy: We value your privacy and handle your personal information in accordance with our Privacy Policy. By using our marketplace, you consent to the collection, storage, and use of your information as described in our Privacy Policy.
    
    
12. Modifications: We reserve the right to modify or update these Terms of Use at any time. It is your responsibility to regularly check for any changes. Continued use of our marketplace after modifications implies acceptance of the updated terms.
    
    
13. Termination: We reserve the right to suspend or terminate your access to our marketplace if you violate these Terms of Use or engage in any activity that is harmful or disruptive to our platform or community.

At Decal Venue, we have established clear guidelines for both stickers and digital downloads to create a safe and respectful marketplace environment. These guidelines apply to all products sold on our platform, ensuring that our customers have a positive experience and are protected from any offensive or harmful content.

For Stickers and Digital Downloads:

1. Explicit or Adult Content: We strictly prohibit the sale of items that contain explicit sexual content, nudity, or pornography.
2. Violence and Self-Harm: Products that promote violence, harm, or self-destructive behavior are not allowed.
3. Hate Speech and Intolerance: Items that promote discrimination, hatred, or prejudice based on factors such as race, ethnicity, religion, gender, sexual orientation, or disability are strictly prohibited.
4. Illicit Substances: Products that promote or encourage the use of illegal drugs or substances are not allowed.
5. Child Abuse: Any items that depict or promote child abuse, exploitation, or endangerment are strictly prohibited.
6. Terrorism: Items that promote or support terrorism, violence against civilians, or any form of terrorism-related activities are not allowed.
7. Copyright Infringement: Items that violate copyright laws or infringe upon the intellectual property rights of others are strictly prohibited.
8. Fraud and Scams: Products that promote fraudulent activities, scams, or unethical behavior are not allowed.

We take violations of these guidelines seriously and will take appropriate actions, including removing the content and potentially suspending or terminating the account of the offender. Your safety and satisfaction are our top priorities, and we appreciate your cooperation in maintaining a positive and inclusive marketplace.
